Wrongful Death Lawsuit Filed.
On January 3, 2011 the Law Offices of Joseph T. Joseph filed a wrongful death lawsuit against the Guernsey County Sheriff’s Office and its employees, Guernsey County, the Cambridge Police Department and its employees, and the City of Cambridge on behalf of decedent's estate. The Complaint alleges that the decedent was taken into custody by the Guernsey County Sheriff’s Office and the Cambridge Police Department on the suspicion that he was operating a motor vehicle while intoxicated. The Complaint further alleges that the decedent was not intoxicated at the time of his arrest but rather on his way to the hospital to seek medical care. The Complaint also claims that instead of assisting the decedent in obtaining medical attention, the decedent was held without any concern for his medical condition. While in the custody of the named Defendants, the decedent died of acute myocardial infarction.
The Complaint states that the named parties failed in their duty to follow proper protocol, failed to obtain medical assistance for the decedent, obstructed the decedent from obtaining the medical care he was seeking, failed to properly train their employees, and acted with reckless disregard towards the decedent's health and well being.
An unspecific amount of damages is being sought.
