What is a Wrongful Death?

A death can be a traumatic experience for an Ohio family. Whether the loss involves a beloved grandparent or the unexpected passing of a young relation, a death can change the way that family members connect and interact.

Many deaths can be anticipated, such as those that come with old age and illness. However, deaths that occur as a result of traumas and accidents can be particularly hard to cope with because they are unforeseen and distressing.

When an unexpected death occurs because of an accident, the family members who survive the deceased party may be left in an emotionally and financially difficult place. If the deceased party was the financial supporter of their spouse and dependents, then their survivors may struggle to make ends meet.

Accidents that are caused by the negligence and recklessness of others are in some cases sufficient to serve as the bases of legal claims for damages.

One of the primary claims that a deceased party’s family may pursue is a wrongful death claim.

A wrongful death claim alleges that someone died due to the breach of another person’s duty to them. Negligence is often the cause of such deaths and in Ohio only family members who directly suffered losses from the death, such as spouses, parents, and children, may pursue such claims.

Starting a lawsuit in the wake of a beloved family member’s passing may seem like a difficult task, and therefore many families that are struggling with wrongful deaths allow personal injury attorneys to support them. These legal professionals can direct their clients through the legal and procedural requirements for filing such claims and pursuing their rights to compensation.
